1. Parties

These Terms of Use and Membership Agreement ("Agreement") are concluded between PostaImza ("PostaImza") and the "User" who uses the website named www.postaimza.com as a User, Member or Visitor. .

2. Purpose of the Agreement

2.1. It determines under which conditions the services to be provided by PostaImza to the User will be provided on the website with the domain name www.postaimza.com ("Website") owned by PostaImza.

2.2. PostaImza is a service that provides e-mail signature creation service. This service is provided through the website that broadcasts on the domain name www.postaimza.com.

2.3. This Agreement is valid for all natural and legal persons who use and visit the PostaImza website.

2.4. Use of the Website indicates that this Agreement has been read and accepted by everyone who visits the Website. Therefore, this Agreement is binding on Users, Visitors and Members who benefit from the Website. Users of this Website, whether they are Visitors or Members, are deemed to have undertaken to act in accordance with the provisions of this Agreement. The word "User(s)" in the contract text also includes the definitions of "Member(s)" and "Visitor(s)".

By accessing, viewing or using this Website, you agree that you have read and understood these terms and will comply with all applicable laws.

If you do not accept the terms set forth in this Agreement, please stop using the Website.

3. Obligations of the User

  1. The User declares and undertakes that he has read the entirety of this Agreement, fully understands its content, and accepts and approves all matters on the Website specified in the Agreement, unconditionally and unconditionally.
  2. The user may in no way violate the public order, violate general morality, disturb or harass others, for an illegal purpose, and to protect the intellectual or industrial rights of others (copyright, trademark or patent, etc.) cannot be used in a way to rape. The usage rights of the User with this Agreement belong solely to him/her and cannot be transferred to others. The member is responsible for the use of the user name and/or password by other people and cannot hold PostaImza responsible in any way for any problems that may occur.
  4. The user is under his/her own responsibility to ensure the security of the username and password that he/she determines while becoming a member of PostaImza, to take the necessary precautions, not to use the membership accounts, user names and passwords of other members, not to access their data without permission and not to share their passwords with others. , otherwise the legal and penal responsibilities arising from this will belong to him; to notify PostaImza immediately when they learn that their member accounts are used by unauthorized persons or that their passwords have been obtained by others; It accepts and undertakes that PostaImza cannot be held responsible for the seizure of members' passwords, membership accounts, user names by third parties.
  5. The User agrees not to access and/or use the software, personal data or other information of other Users who benefit from the services provided through the Website, and not to make them available to third parties and organizations.
  6. The user can send messages containing illegal information, chain mail, viruses, worms, etc. will not distribute any other content that may harm third parties, such as malicious software; It accepts, declares and undertakes not to send programs and/or information or use a method that will harm the information or software on other Users' computers.
  7. As long as the user benefits from the services offered on the Website, he/she shall comply with the provisions of the Law on Intellectual and Artistic Works, Industrial Property Law, Turkish Commercial Code, Turkish Penal Code, Turkish Code of Obligations and other legislation, and the notices published by PostaImza. agrees, declares and undertakes not to violate it.
  8. All intellectual and financial rights of the PostaImza logo, the PostaImza Client software/source code and the content of the postaimza.com web application that can be seen on the Website belong to PostaImza. The User shall not use any method to monitor and/or copy, reproduce, modify the contents of the Web Site or for other unauthorized purposes; It accepts, declares and undertakes that it will not produce derivative works from this content or display them to the public.
  9. The User knows that he/she can include graphics, text, pictures, images, texts and similar content provided by the Users through the Website and therefore the User who publishes the content is responsible for any content provided by other Users and that PostaImza accepts, declares and undertakes that he is not responsible in any way and that he has the right to remove the relevant content from the publication, in case that content is published by him, in case this content is contrary to the publishing principles and laws of PostaImza or is evaluated in this way by PostaImza.
  10. The user declares that the information he/she will give about him/her is correct, that he/she will update his/her information at the earliest opportunity and within this period if the information given is changed, if a period of time is stipulated by the law, that all opinions, thoughts, expressions and pictures to be published by him have no interest or involvement with PostaImza. declares, accepts and warrants that it has no connection and that they will only bind itself.
  11. The user may not use the Web Site as a commercial promotion area. It may not attempt to promote or sell products or services through the Site or to direct other Users to sales channels. PostaImza, at its discretion, has the right to terminate the memberships of the Members it determines to use the Website for these purposes.
  12. The member may not claim any rights from PostaImza in the event that his/her membership is terminated by PostaImza.
  13. Because the User, whether a Member or just a Visitor, violates any of its obligations hereunder;
    • In case of loss, it does not have the right to demand this from PostaImza, and it will not direct any lawsuit or demand to PostaImza for this purpose,
    • He/she knows that if a third party suffers a loss due to his/her violation, he/she will remedy the damage immediately and at the time of the first request, and if he/she does not remedy the damage, PostaImza shall recourse to him with all its legal interests and other accessories, from the date on which it pays the damage,
    • If PostaImza causes the payment of a judicial or administrative fine due to the violation, PostaImza knows that it will recourse this amount together with all legal interests and other accessories as of the actual payment date,
    • In the event that PostaImza suffers a direct loss due to its violation, it accepts, declares and undertakes that it will pay the related loss to PostaImza, together with all legal interest and ancillaries, as of the date of the damage.

4. Authorizations of the Website

  1. PostaImza always has the right to unilaterally stop the service offered to the User, Member, permanently or temporarily, as well as to postpone, limit and destroy the access to any page or service without giving a reason or warning. For this reason, the user cannot hold PostaImza responsible under any name.
  2. PostaImza has the right to terminate or suspend the use, memberships without any explanation, of the Members who provide incomplete or incorrect membership information, and the Users who act in violation of the other terms of use described in this Agreement and the Website. In addition, PostaImza has the right to terminate or freeze the accounts of the Members that it detects that it has not been updated during a certain period of time, without any explanation.
  3. PostaImza does not guarantee that the services it provides on the Web Site will be uninterrupted or error-free, or that certain results will be obtained by using the content of the site or linking to the site. Although PostaImza has taken all kinds of security measures regarding the service it offers from the Website, it does not guarantee that the system of the Users and Members will not be damaged due to any application or file or similar content uploaded to the site by the Users due to the nature of the information systems. PostaImza cannot be held responsible for any damages that may arise from the use of the Web Site, including direct, indirect or incidental damages, consequential damages and punitive damages.
  4. PostaImza has the right to reject, delay, publish late, not publish or unpublish content, e-mail or any message on its pages from Users without showing any reason.
  5. The right to make advertisement and promotional activities on the Website belongs only to PostaImza or to 3rd parties authorized by PostaImza.
  6. PostalSignature may offer links to other sites on the Web Site, which may or may not be its own brand. Considering that the contents of the websites to which PostaImza provides links or recommends may change over time, the visits to these websites due to links to external websites or recommendations made regarding external websites, Users' use of information, the privacy principles of the relevant sites and their content will be completely excluded. external website is responsible, PostaImza is not.
  7. The collection of user names, e-mails and other personal data on the Website by unauthorized and unauthorized persons for any reason constitutes a crime in accordance with the relevant legislation.
  8. The content of publications from the Website may not be suitable for children under the age of 18. PostaImza does not knowingly request information from children under the age of 18. If we become aware in any way that a User under the age of 18 has shared personal information with PostaImza, we will delete this information from PostaImza systems. If a parent realizes that their child has shared their personal information with PostaImza without their consent, they can request that this personal information be deleted by contacting PostaImza. Except for those that will occur for legal reasons, the records are immediately deleted from our system.
  9. PostalSignature is not responsible for any update errors caused by technical reasons, and can update and change the services posted and announced on the site at any time.

5. Privacy and Processing of Personal Data

We care about your privacy. For this reason, your personal data will not be sold and/or shared with third parties for any purpose.

In order to provide you with a better service and to understand your needs, PostaImza collects and uses your personal information by making appropriate notifications and obtaining approval. You accept, declare and undertake the following terms and conditions if you use this Web Site and only remain as a User or become a Member by completing your membership.

PostaImza, in addition to the information you provide, may collect your non-personal data through Automatic Data Collection Tools such as frequently used information collection tools (for example, Google Analytics) when you visit the Website. These tools collect certain standard information that your browser sends to the Website, such as your browser type and language, operating system information, access times. The personal data collected within the scope of your membership are deleted, destroyed or anonymized ex officio by the Member's request or by PostaImza, without prejudice to the periods stipulated by the relevant legislation, after the Membership is terminated by the Member itself or by PostaImza.

The member has the right to terminate his membership at any time. Membership cannot be transferred or sold to third parties.

Your personal data processed by PostaImza are stored in a secure and encrypted manner, without allowing unauthorized access, by taking all kinds of administrative and technical security measures by us in accordance with the Law on Protection of Personal Data No. 6698.

You can view detailed information about the Member's other rights on personal data, the principles and methods of processing personal data, and the administrative and technical security measures taken regarding the data on our website at www.postaimza.com.

6. Termination and Changes

PostaImza and the User may terminate this Agreement at any time.

PostaImza has the right to unilaterally make changes, adjustments and updates in the terms of this Agreement, in the services it provides on the Website, at any time and/or in accordance with legal regulations. These changes, adjustments and updates are deemed valid from the moment they are published on the Website. Users are deemed to have accepted the updated/changed/adjusted articles in their use each time they enter the Web Site.

User, Member; As of the date on which PostaImza started to use the service to be provided in accordance with the provisions of this Agreement, to immediately compensate for any damages and losses incurred by PostaImza and/or third parties due to acts contrary to the rights and obligations set forth in the Contract and/or failure to fulfill its performances and commitments. and PostaImza can terminate the Agreement unilaterally by canceling its membership.

7. Dispute

This Agreement is subject to the laws of the Republic of Turkey, regardless of conflict of laws rules, will be resolved in accordance with the relevant laws and Istanbul Courts will be authorized on the relevant issue.

8. Notification Addresses

The postal address shared by the User or Member with PostaImza is considered the legal notification address for any notification regarding this Agreement.

The User or the Member accepts that the notifications to the old mail address will be valid and will be deemed to have been made to him, unless he notifies PostaImza in writing of changes in his current address within 3 (three) days or makes the relevant changes using the form on his profile page.

Any notification made by PostaImza using the Member's e-mail address registered in the system due to this Agreement shall be valid, and it will be deemed that the e-mail reaches the Member 1 (one) day after it is sent by PostaImza.

9. Effectiveness

The User or Member declares, accepts and undertakes that he/she has read, understood and accepted all of the articles in this Agreement and confirms the accuracy of the information he/she has given about him/her. This Agreement was concluded at the time the User or Member entered the Website or became a Member and entered into force mutually and indefinitely. The Agreement will automatically become null and void without the need for any warning upon termination of membership or the realization of any of the termination conditions listed in this Agreement.
